Please read these Terms of Service ("Terms") carefully before using NextSkin's telemedicine platform. By accessing or using our services, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using NextSkin's services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use our services.

2. Description of Services

NextSkin provides an online telemedicine platform connecting patients with licensed dermatologists for:

• Asynchronous consultations via photo and questionnaire submission
• Diagnosis and treatment recommendations for dermatological conditions
• Prescription services where medically appropriate
• Follow-up care and treatment monitoring

3. Medical Disclaimer

The medical advice provided through NextSkin is based on the information you provide and may differ from advice given during an in-person examination. Our dermatologists will recommend an in-person visit when necessary.

4. Eligibility

To use NextSkin services, you must:

• Be at least 18 years old (or have parental/guardian consent)
• Be located in a jurisdiction where we are authorized to provide services
• Provide accurate and complete information about your health
• Have the legal capacity to enter into these Terms

5. User Responsibilities

You agree to:

• Provide accurate, current, and complete information during registration and consultations
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Use our services only for their intended purpose
• Follow the treatment recommendations provided by our healthcare providers
• Not share your account or prescription medications with others

6. Fees and Payment

Our consultation fees are displayed at the time of service. By submitting a consultation:

• You authorize us to charge your selected payment method
• You acknowledge that consultation fees are non-refundable once a physician has reviewed your case
• Prescription medication costs are separate and paid directly to the pharmacy

7. Prescriptions

If our dermatologists prescribe medication:

• Prescriptions are issued at the sole discretion of the treating physician
• We cannot guarantee that any specific medication will be prescribed
• Prescriptions are valid only for the patient to whom they are issued
• Controlled substances and certain medications may not be available through our platform

8. Intellectual Property

All content on our platform, including text, graphics, logos, and software, is the property of NextSkin or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written consent.

9. Limitation of Liability

To the maximum extent permitted by law:

• NextSkin and its healthcare providers are not liable for indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount paid for the specific consultation giving rise to the claim
• We do not guarantee specific health outcomes

10. Indemnification

You agree to indemnify and hold harmless NextSkin, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services or violation of these Terms.

11. Termination

We may terminate or suspend your account at any time for violation of these Terms or for any other reason. Upon termination, your right to use our services will cease immediately. Provisions that by their nature should survive termination shall survive.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Germany. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Berlin, Germany.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our platform and updating the "Last updated" date. Continued use of our services after changes constitutes acceptance of the modified Terms.
